TERMS AND CONDITIONS OF USING THE ER.YO APPLICATION
These Terms and Conditions define the rules for using the ER.YO mobile application (the “Application”), created and operated by ER.YO Sp. z o.o. (the “Company”), presenting original content created by a single Creator – Lara (the “Creator”).
These Terms have been prepared in accordance with applicable law, including consumer protection regulations, GDPR, and the Apple App Store Review Guidelines and Google Play Developer Policies.
Access to the Application is available only with an active Subscription.
I. Definitions
Application – the ER.YO mobile application available on Apple App Store and Google Play.
User – a natural person who is at least 18 years old and uses the Application after purchasing a Subscription.
Creator – Lara, the sole author of the content published in the Application.
Content – digital materials published in the Application, including in particular photos, videos, audio materials and posts of an artistic, lifestyle or original nature.
Subscription – paid, time-limited access to the Content in the Application.
II. Acceptance of the Terms
Downloading the Application, creating an account and purchasing a Subscription constitute acceptance of these Terms.
Failure to accept the Terms makes it impossible to use the Application.
The Company reserves the right to amend these Terms. The current version will always be available in the Application. Continued use of the Application after changes are introduced constitutes acceptance of the updated Terms.
III. Age Requirement and Nature of the Content
The Application is intended exclusively for users aged 18 or older.
The Application may contain content of a: lifestyle, artistic, original, suggestive nature.
Pornographic, erotic, obscene or NSFW content is strictly prohibited, including in particular: display of genitals, sexual acts or simulations thereof, explicit erotic material.
Users may only view the Content published in the Application.
Within the Application: there is always one Creator only, Users cannot publish, comment on or upload any content, no social or communication features are available.
The Application complies with Apple App Store and Google Play policies regarding adult-oriented content.
IV. Subscription and Payments
Access to the Content requires an active Subscription.
Available Subscription plans: 4 months – paid in advance, 12 months – paid in advance.
Subscriptions may be purchased:
a) within the Application via Apple In-App Purchase or Google Play Billing,
b) outside the Application via the Creator’s official website (dedicated landing store).
If the Subscription is purchased outside the Application, access to the Content is activated after logging in to the User account.
The Company does not have access to Users’ payment card or financial details.
Subscription prices in external app stores (Apple App Store / Google Play) may be higher due to commissions charged by those platforms.
V. Right of Withdrawal and Cancellation
Pursuant to art. 38 pkt 13 of the Polish Act on Consumer Rights, the User acknowledges that once the digital service has begun (access to the Content is granted), the right of withdrawal is lost.
By purchasing a Subscription, the User: expressly agrees to immediate access to digital content, acknowledges that the Subscription is non-refundable once the service has begun.
The Subscription may be cancelled at any time, however cancellation does not result in a refund for any unused period.
Subscription management is handled exclusively through the User’s Apple ID or Google Play account, in accordance with the policies of the relevant platform.
VI. Intellectual Property Rights
All Content published in the Application is the property of the Creator or the Company and is protected by copyright law.
It is strictly prohibited to: copy the Content, record the screen, share the Content with third parties, publish the Content outside the Application, use the Content for commercial or private purposes.
Violation of intellectual property rights may result in immediate account termination without refund.
VII. User Obligations
The User undertakes to use the Application: in compliance with applicable law, in accordance with these Terms, in accordance with Apple App Store and Google Play guidelines.
In particular, the User is prohibited from: sharing their account with third parties, attempting to bypass technical safeguards, engaging in actions that may harm the reputation of the Creator or the Company.
VIII. Liability
The Application is provided on an “as is” basis.
The Company shall not be liable for: temporary technical interruptions, data loss caused by factors beyond its control, decisions made by Users based on the Content.
IX. Suspension or Termination of Account
The Company reserves the right to suspend or permanently terminate a User account in the event of a breach of these Terms.
In such cases, the Subscription is non-refundable.
X. Personal Data Protection
The controller of personal data is ER.YO Sp. z o.o.
Detailed rules regarding the processing of personal data are set out in the ER.YO Privacy Policy, which forms an integral part of these Terms.
XI. Governing Law
These Terms are governed by Polish law.
Any disputes shall be resolved by courts having jurisdiction over the registered office of the Company.
XII. Apple App Store and Google Play Disclaimer
Apple and Google are not parties to these Terms and bear no responsibility for the Application or its Content.
All complaints, support requests and inquiries regarding the Application should be directed to the Company.

By using the ER.YO Application, the User confirms that they are at least 18 years old, understand the nature of the Content, and accept these Terms and Conditions.
